PARENT RESISTANCE & COOPERATION

My parent signed a POA but now refuses to cooperate — what can I actually do?

A POA does not automatically remove a capable parent’s control. Resistance may reflect autonomy, fear, distrust, misunderstanding, possible cognitive change, or exploitation concerns.

Prompt review

Your situation

Your parent signed a POA but now resists help, withholds information, or changes their mind.

What to check first

1

Confirm whether the POA is currently effective.

2

Ask whether the parent is revoking authority, refusing a specific action, or simply refusing cooperation.

3

Separate ordinary autonomy and conflict from a possible capacity or exploitation concern.

Common rule

A POA does not by itself erase the principal’s decision-making rights. A principal who retains the required legal capacity may generally continue acting and may be able to revoke the POA, depending on the governing law and the document.

What not to assume

!

Do not force compliance just because you are named as agent.

!

Do not treat disagreement or bad choices as proof of incapacity.

!

Do not ignore a possible revocation or safety concern.

What you can do now

✓

Clarify the parent’s exact objection.

✓

Document what authority exists and what action is being resisted.

✓

Use the least coercive path that addresses the actual risk.

When professional help becomes important

Prompt legal review is appropriate if revocation is disputed, capacity is genuinely in question, exploitation is suspected, or immediate safety/asset harm is possible.

Jurisdiction matters

QC, CA

Au Québec, même après homologation d’un mandat de protection, le mandant conserve ses droits et son autonomie doit être sauvegardée; un désaccord ne suffit pas à lui seul à établir une incapacité décisionnelle pour chaque acte.

BC, CA

BC law starts from a presumption of capability; resistance or disagreement should not be treated as incapacity without applying the relevant legal test.

ON, CA

Ontario capacity is specific to the decision and may change over time; disagreement or an unwise choice does not by itself establish incapacity.
