In Quebec, is my parent’s power of attorney enough if they become incapable?
In Quebec, a power of attorney and a protection mandate do not do the same job. A power of attorney covers property and administrative acts while the person is capable and ends if the court declares the person incapable. A protection mandate is a different document and takes effect only after homologation.

Having a power of attorney is therefore not the same as having an incapacity plan. Parent Ready helps the family verify what authority exists now, whether a protection mandate exists, where the original is kept, who is named, and what would have to happen before that person could act.
